General Terms and Conditions for Prospective Tenants

Last updated: 5 November 2026. General Terms and Conditions of Immomio GmbH for the use of the platform by prospective tenants – including Immomio Now.

This English translation is provided for convenience only. The German version is legally binding.

These General Terms and Conditions (hereinafter ‘Terms’) govern the use of the ‘immomio’ platform (immomio.com) by prospective tenants.

The operator of the platform and service provider within the meaning of the German Digital Services Act (Digitale-Dienste-Gesetz, DDG) is Immomio GmbH, Zippelhaus 2, 20457 Hamburg, telephone: 040 882 159 890, email: kontakt@immomio.de, registered in the commercial register of the Local Court (Amtsgericht) of Hamburg under number HRB 134679, represented by its managing director Nicolas Jacobi, VAT ID: DE297626954 (hereinafter ‘Immomio’, ‘we’, ‘us’).

These Terms consist of five parts:

  • In Part 1 you will find the General Terms of Use for all visitors and users of our platform.
  • Part 2 contains the General Terms and Conditions for all prospective tenants registered on our platform. It also applies to subscribers of Immomio Now, unless Parts 3 to 5 of these Terms provide otherwise.
  • Part 3 sets out the terms and conditions for subscribers of Immomio Now. It also applies to subscribers of a paid Immomio Now subscription, unless Part 4 provides otherwise, and to subscribers of a free Immomio Now subscription with a housing entitlement certificate (Wohnberechtigungsschein, WBS), unless Part 5 provides otherwise.
  • Part 4 contains additional terms and conditions for subscribers of a paid Immomio Now subscription.
  • Part 5 contains the terms and conditions for subscribers of a free Immomio Now subscription with a housing entitlement certificate (WBS).

If you take out your Immomio Now subscription as a consumer, you have a statutory right of withdrawal.

  • The cancellation policy for a free Immomio Now subscription (with or without a WBS) can be found below in Annex 1 to these Terms.
  • The cancellation policy for a paid Immomio Now subscription can be found below in Annex 2 to these Terms.
  • A model withdrawal form can be found below in Annex 3 to these Terms.

You can find our privacy policy here.

If you use the platform as a provider or as an employee of a provider, these Terms do not apply to you; instead, the General Terms and Conditions of Immomio GmbH for the provision of IT services to business customers apply.

Part 1 – General Terms of Use

§ 1 Scope

This Part 1 (General Terms of Use) applies to every visit to and every use of the platform, regardless of whether you have registered as a user of the platform. If, however, you are a registered user (see Part 2 of these Terms), these General Terms of Use also form part of your contract of use. If you have taken out an Immomio Now subscription, Part 1 also applies to that subscription.

§ 2 Definitions

Where we use the following terms in these Terms, they have the meaning defined below:

  • ‘Provider’ means landlords, housing companies, property management companies and other businesses that publish properties on the platform and offer them for rent.
  • ‘Basic account’ or ‘user account’ means the user’s free user account under Part 2 of these Terms.
  • ‘Visitor’ means persons who use our platform without having registered as a user.
  • ‘User’ or ‘prospective tenant’ means a user registered on our platform. Prospective tenants within the meaning of these Terms also include users who use the platform to search for or apply for properties for purchase.
  • ‘Property’ means the flat or other usable space (such as garages or commercial property) advertised and offered on the platform by the provider.
  • ‘Platform’ means the digital services for prospective tenants operated by Immomio on the website immomio.com, including the user interfaces, interfaces and IT systems used for this purpose.
  • ‘Registration’ means registration on the platform as a prospective tenant by concluding the contract of use with Immomio (see Part 2 of these Terms, § 3).
  • ‘Staged model’ means the model explained here of managing the user’s personal data on a fiduciary basis and disclosing it step by step to the respective provider in line with the progress of the respective application process.
  • ‘Tenant’ means the logically isolated technical client environment of the respective provider on the platform.
  • ‘Connected provider’ has the meaning explained in Part 2, § 5.
  • ‘Housing entitlement certificate’ or ‘WBS’ (Wohnberechtigungsschein) means the time-limited certificate issued by the competent German authority with which a person seeking housing proves to the provider their entitlement to occupy WBS-restricted housing, in particular under Section 27 of the German Housing Promotion Act (Wohnraumförderungsgesetz),
    Section 5 of the German Housing Commitment Act (Wohnungsbindungsgesetz) or the corresponding laws of the federal states.
  • ‘WBS-restricted housing’ means flats which, owing to occupancy restrictions under public law, the provider may only let to persons seeking housing who prove their entitlement to housing by means of a housing entitlement certificate, in particular under Section 27 of the Housing Promotion Act, Section 5 of the Housing Commitment Act or the corresponding laws of the federal states.

§ 3 Permitted use and prohibited actions

(1) The platform may only be used for the purposes agreed with the user or for other lawful purposes. Any misuse of the platform is prohibited.

(2) Misuse of the platform exists in particular in the following cases:

  • the use of bots, crawlers, spiders, scripts or other automated means to register or log in on the platform or to access areas of the platform that are only accessible after logging in, to query data there, to send applications or other messages, or to extract content (scraping), unless we have expressly permitted this;
  • the systematic extraction, copying, storage or compilation of flat listings, provider data or other platform content, in particular to build your own databases or to pass them on to third parties;
  • the use of platform content that is only accessible after registration or logging in to a user account for text and data mining, including the training of AI systems; Immomio expressly reserves these uses pursuant to Section 44b(3) of the German Copyright Act (Urheberrechtsgesetz, UrhG);
  • circumventing, deactivating or impairing technical protection measures, access restrictions or query limits (e.g. rate limits, CAPTCHAs);
  • decompiling, disassembling or otherwise reverse engineering the software provided via the platform into source code, unless this is mandatorily permitted under Sections 69d and 69e UrhG;
  • uploading malware (viruses, worms, Trojans) and any action that endangers the functionality or security of the platform or places an unreasonable load on the infrastructure.

§ 4 Notice procedure, content moderation and complaints

(1) You can report to us electronically any content on our platform that you consider to be illegal, using the link provided in the footer of the website (‘Report illegal content’).

(2) We may remove or block content that violates these Terms or is otherwise illegal. In the event of violations of § 3 of the General Terms of Use, we may technically restrict or prevent access to the platform, for example by means of query limits or by blocking IP addresses. In relation to registered users, we may additionally take the measures described in Part 2, § 8(7) of these Terms.

(3) You may lodge a complaint within six months of being notified of the decision against decisions by which we remove or block content, suspend or terminate our services in whole or in part, or suspend or close an account, as well as against our decision on a notice. The complaint is free of charge and is submitted electronically via our contact form. It should identify the decision being challenged and state the reasons. Complaints are decided by Immomio employees; we will notify you of the reasoned decision.

§ 5 Consumer dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG (German Consumer Dispute Resolution Act)). This does not affect the possibility of out-of-court dispute resolution under § 4(3) of the General Terms of Use.

§ 6 Liability

(1) Immomio has unlimited liability in cases of intent and gross negligence, for injury to life, body or health, within the scope of a guarantee it has assumed and under the German Product Liability Act (Produkthaftungsgesetz).

(2) In cases of slight negligence, Immomio is only liable for the breach of a material contractual obligation whose fulfilment makes the proper performance of the contract possible in the first place, whose breach jeopardises the achievement of the purpose of the contract and on whose observance you may regularly rely (cardinal obligation). In this case, liability is limited to the damage foreseeable at the time the contract was concluded and typical of the contract. Cardinal obligations include in particular the provision of the agreed services, the correct transmission of your data to the providers you have selected and the protection of your data against unauthorised access in line with the state of the art.

(3) In all other respects, liability for slight negligence is excluded.

(4) The above limitations also apply in favour of Immomio’s legal representatives, employees and vicarious agents. Liability under the General Data Protection Regulation (in particular Art. 82 GDPR) remains unaffected.

§ 7 Applicable law and place of jurisdiction

(1) Immomio’s platform is aimed exclusively at users of full age with full legal capacity whose habitual residence or registered office is in Germany.

(2) The language of the contract is German.

(3) The consumer rights granted in these Terms are only available to you if you use the platform as a consumer. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession (Section 13 BGB (German Civil Code)).

(4) If the user is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Hamburg. The same applies if, after the contract has been concluded, you move your place of residence or habitual residence out of Germany or if your place of residence or habitual residence is not known at the time the action is filed (Section 38 ZPO (German Code of Civil Procedure)). In all other respects, the statutory places of jurisdiction apply.

§ 8 Amendments to these General Terms of Use

(1) We may amend these General Terms of Use with effect for the future, in particular to adapt them to new functions, technical developments or legal requirements. You can access the current version at any time at www.immomio.com/nutzungsbedingungen.

(2) In relation to registered users (Part 2 of these Terms) or subscribers (Parts 3 to 5 of these Terms), amendments only become part of the contract in accordance with the provisions applicable to them in each case.

Part 2 – Terms and conditions for all registered prospective tenants

§ 1 Scope and incorporation

(1) These terms and conditions (Part 2) apply when you register as a user of Immomio. They also apply to subscribers of Immomio Now, unless the terms and conditions for subscribers in Parts 3 to 5 provide otherwise.

(2) These Terms become part of the contract if you were expressly referred to them during registration, were able to take note of them in a reasonable manner and declared by registering that you agree to their application. Deviating terms of the user only apply if we expressly agree to them. Individual agreements always take precedence over these Terms.

§ 2 Subject matter of Immomio’s services

(1) Via the user’s user account, Immomio provides the user with a technical infrastructure and, by means of it, a technical marketplace. On this technical marketplace, providers can offer properties for rent to the user and users can apply for such offers. The provider and the user can communicate with each other directly for the purposes of the application for the property. The search functions available on the platform (i.e. in particular the user’s search profiles and the provider’s ideal tenant profiles) are always free of charge for the user.

(2) Immomio ensures that only providers that have their own tenant on the platform can offer properties for rent and communicate with the user via the platform. This ensures that the providers are reputable and that the user’s personal data is protected by the functions of the basic account (§ 4).

(3) Immomio itself is not a provider, landlord or agent of the properties. Immomio acts neither as the user’s representative nor as the provider’s representative, does not make its own preselection among applicants and does not influence the provider’s decision. The selection of applicants, invitations to viewings and the negotiation and conclusion of the tenancy agreement are solely the responsibility of the provider.

(4) The provider determines the property, the rent, the contractual terms and its selection criteria on its own responsibility. The respective provider alone is responsible for the accuracy and completeness of the information about the property (e.g. size, features, location, rent) and its availability. If you discover illegal content from a provider, please use the notice procedure explained in Part 1, § 4.

(5) If you use search functions for properties in your user account, the selection of the flat listings displayed is based on how well they match your search criteria and, where there are several search results, the order is based on the date of publication (newest first). You can change the selection by adjusting your search criteria, and the order by choosing a different sorting option in the results list. Whether you take out an Immomio Now subscription, or whether it is a paid subscription, has no influence on the order.

§ 3 Registration and conclusion of the contract

(1) Registration by the user is required to use Immomio. There is no entitlement to registration.

(2) By registering, you conclude a free-of-charge contract of use with Immomio for the use of your personal user account (‘basic account’, see § 4).

(3) To register, please enter your name, your email address and a password of your choice on Immomio’s registration page and then click the ‘Register’ button. By clicking this button, you submit a binding offer to conclude the contract of use, incorporating the Terms linked there. We will send you an email without undue delay with a link to confirm your email address. The contract is concluded when you click on the confirmation link.

(4) To protect against automated and abusive registrations, we do not accept email addresses from providers of temporary disposable email addresses. For this purpose, we automatically compare the domain of the email address provided with a list of such providers maintained by us. If you believe that your address has been wrongly rejected, you can contact us via our contact form; an employee will then review the case.

(5) Before submitting, you can correct your entries in the input fields at any time using the usual keyboard and mouse functions. Mandatory details that we recognise as incorrect or incomplete are flagged before submission. After registration, you can change your details at any time in the profile section of your user account.

§ 4 Basic account

(1) When you register as a user of Immomio (see § 3 for details), Immomio provides you with a personal user account (‘basic account’).

(2) The basic account is free of charge. In your basic account, you have the option of additionally taking out an Immomio Now subscription. Depending on the product you choose, the Immomio Now subscription may be subject to a charge (see Parts 3 to 5 of these Terms).

(3) The basic account includes in particular the following functions available to the user

  • creating and managing a tenant profile, including the option of uploading documents;
  • creating and managing search profiles in order to be found by connected providers (§ 5) with suitable properties;
  • searching and filtering the flat listings of connected providers (§ 5) published on the platform;
  • the management of your data as a data trustee (§ 6) and the step-by-step release of your data to the connected provider (§ 5) in the event of your application;
  • matching (§ 7);
  • direct communication with connected providers (§ 5) via the platform, e.g. to arrange viewing appointments;
  • automatic status updates and notifications to the user at the email address they have provided;

§ 5 Connected providers

(1) You can only use the functions of the basic account (§ 4) in relation to connected providers. If you would also like to use these functions in relation to other providers on the platform, you need an Immomio Now subscription (see Parts 3 to 5 of these Terms).

(2) Connected providers are providers that use the platform and that you actively link to your basic account. There are two ways in which you can establish such a connection:

(a) You register as a user of Immomio via a link provided by the provider on its website and create a search profile in the process. If you already have a basic account with Immomio, you can log in via this link and the connection is established even without creating a search profile.

(b) You apply for a property that the provider has advertised on its website or on third-party property portals and, in this context, register as a user of Immomio via the link provided by the provider. If you already have a basic account with Immomio, you can log in via this link and thereby connect your basic account to this provider.

(3) The decision as to whether a linking route is possible and, if so, which one, rests solely with the provider. Concluding the contract of use for the basic account does not give rise to any claim against Immomio that a particular provider will permit such a link.

§ 6 Data trust

(1) Immomio undertakes towards the user to process the personal data in their tenant profile on a fiduciary basis. Immomio discloses this data to the respective provider in the provider’s tenant on the platform in accordance with Immomio’s staged model (‘release’).

(2) The release takes place automatically, depending on which stage of an application the user decides to enter. The decision as to whether to apply for a property rests solely with the user. The user may also decide at any time to withdraw an application.

(3) The user and the provider are free to exchange additional data if required; however, Immomio assumes no responsibility and no obligations as a data trustee in this respect.

§ 7 Matching

(1) Immomio undertakes towards the user to use a matching procedure so that the user can receive suitable offers from providers without having to disclose the personal data in their tenant profile or search profile for this purpose.

(2) As part of the matching, an aggregated mathematical value is calculated indicating the extent to which the details provided by the prospective tenant in their tenant profile and search profile correspond to the criteria, and their weighting, that the landlord has defined in an ideal tenant profile for the property. This value shows how well or poorly the landlord’s offer and the prospective tenant’s request match each other, without allowing any conclusions to be drawn about specific personal data of the prospective tenant.

(3) If the provider offers the user a property on the basis of the matching and the user applies for it, any further disclosure of the user’s data takes place in accordance with § 6.

§ 8 Obligations of the user

(1) You must not misuse your user account for purposes contrary to the contract.

(2) In particular, you are prohibited from:

  • creating several accounts for the same person, in particular in order to apply for the same property more than once;
  • using the platform for third parties or for commercial purposes, for example through paid ‘application services’, flat-finding agencies or the resale of access;
  • providing false or misleading data or providing other persons’ data without authorisation, and uploading forged or manipulated documents (e.g. proof of income, credit reports, housing entitlement certificates);
  • passing on your access data to third parties;
  • sending advertising, spam or chain letters via the platform’s communication functions;
  • using providers’ contact details obtained via the platform for purposes other than applying for the respective property;
  • posting content that violates applicable law, the rights of third parties (in particular copyrights, trade mark rights and personality rights) or these Terms, in particular content that is insulting, discriminatory, threatening or constitutes incitement to hatred (Volksverhetzung).

(3) You are obliged to keep your access data secret and to protect it against access by third parties. If there are indications that your account has been misused, please inform us without undue delay and change your password.

(4) You remain the owner of the rights to content you upload. Insofar as the content is protected by copyright or otherwise eligible for protection, you grant Immomio a simple (non-exclusive), free-of-charge right to use your content, insofar as this is necessary for Immomio to be able to provide the contractual services.

(5) You are responsible for ensuring that your details are complete, truthful and up to date, that you are entitled to upload the content and that you have provided an email address at which you can be reached permanently; email addresses from disposable email providers are not permitted. You can change the data in your tenant profile at any time.

(6) You indemnify Immomio against claims asserted against Immomio by third parties on account of an infringement of rights culpably committed by you in connection with your content or your use of the platform. The indemnity includes the reasonable costs of legal defence. Further statutory claims remain unaffected.

(7) If there are specific indications of a violation of these Terms or applicable law, we may, depending on the severity of the violation, (a) issue a warning, (b) temporarily restrict individual functions, (c) temporarily suspend the account or (d) terminate the contract for good cause in relation to users. The measure depends on the severity, frequency and consequences of the violation. A one-off, inadvertent but material false statement will generally result in a notice; the use of bots or forged documents will regularly justify an immediate temporary suspension; repeated serious violations may result in termination. A temporary suspension generally lasts 30 days. The user may lodge a complaint against such a decision by Immomio in accordance with Part 1, § 4(3).

§ 9 Availability and further development of the platform

(1) We endeavour to ensure that the platform is available with as few interruptions as possible. Where possible, we carry out maintenance work at times of low usage and announce it in advance in the case of foreseeable longer interruptions. Your statutory rights in the event of defects (§ 10) remain unaffected.

(2) We are continuously developing the platform. We may change, extend or restrict the functions of the basic account if there is a valid reason for doing so and the change is reasonable for you, taking your interests into account. Valid reasons are in particular: adaptation to new technical developments or security requirements, implementation of statutory or regulatory requirements, adaptation to changed interfaces of the connected providers and the improvement or extension of functions. Your right to terminate the contract at any time (§ 11(2)) remains unaffected.

§ 10 Rights in the event of defects

The statutory provisions apply to defects of the basic account.

§ 11 Term, termination and account deletion

(1) Your contract of use for the use of the basic account runs for an indefinite period.

(2) You may terminate the contract at any time without notice. You can declare your termination by post, by email or via the contact form on our website, or by deleting your account in the profile section of your user account. You can find more information about the deletion and retention of your data in our privacy policy.

(3) Immomio may terminate the contract of use for the basic account with ordinary notice of two weeks by means of a declaration in text form. If you have additionally taken out an Immomio Now subscription, the provisions applicable under Parts 3 to 5 of these Terms take precedence.

(4) The right of both parties to terminate for good cause remains unaffected; good cause exists for Immomio in particular in the event of serious violations, or violations repeated despite a warning, of Part 1, § 3 or § 8(1) and (2) of this Part 2.

§ 12 Amendments to these Terms

(1) Amendments to these Terms require your express consent, unless paragraph 2 provides otherwise.

(2) Only amendments which

  • exclusively grant you additional rights or services or exclusively reduce your obligations, or
  • are purely linguistic or editorial in nature and do not change the substance of the provisions

take effect without your consent. We will notify you of such amendments in text form before they take effect. If an amendment is disadvantageous for you, even only in part, paragraph 1 applies to the entire amendment.

(3) We will offer you amendments under paragraph 1 in text form no later than one month before they take effect. We will highlight and explain the amendments.

(4) With the offer under paragraph 3, we may already terminate the contract concerned, conditional on your not consenting to the amendments by the time they take effect. We will specifically draw your attention to this consequence in the offer. The termination takes effect at the time the amendments take effect or, in the case of the paid Immomio Now subscription (Part 4 of these Terms), at the end of the billing period in which the amendments take effect. The previous terms continue to apply until the end of the contract. We will refund any fee you have already paid for periods after the end of the contract.

Part 3 – Terms and conditions for subscribers of Immomio Now

§ 1 Scope and incorporation

(1) If you are a registered user of Immomio and take out an Immomio Now subscription (‘Immomio Now subscription’), the terms and conditions of this Part 3 apply in addition.

(2) Immomio Now is offered in the following variants:

  • Free Immomio Now subscription
  • Paid Immomio Now subscription – please also read the additional provisions in Part 4 of these Terms;
  • Free Immomio Now subscription with a WBS – please also read the additional provisions in Part 5 of these Terms.

(3) These Terms become part of the contract if you were expressly referred to them when taking out your subscription, were able to take note of them in a reasonable manner and declared by registering that you agree to their application. Deviating terms of the user only apply if we expressly agree to them. Individual agreements always take precedence over these Terms.

§ 2 Subject matter of the services and requirements

(1) Immomio Now is a subscription to cross-provider platform services. It includes in particular the following services, provided for the term of the subscription:

  • One-time registration: With Immomio Now, you do not have to register individually via the websites or listings of the respective providers or create individual search profiles there, but only register once with Immomio.
  • Connection to all provider tenants in your search region: With Immomio Now, we provide your user account as a cross-provider user account to which not only your connected providers (see Part 2, § 5) but – for the duration of your subscription – the tenants of all providers on Immomio in the search region you have chosen are linked.
  • Provider-independent use: Thanks to the connection to all provider tenants in your search region, you can use our data trusteeship under the staged model (see Part 2, § 6) and the matching procedure (see Part 2, § 7) in relation to any number of providers on Immomio in your search region and communicate with them securely via the platform.

(2) The Immomio Now subscription is a digital service within the meaning of Section 327(2) sentence 2 BGB. Use requires an up-to-date web browser and an internet connection.

(3) An Immomio Now subscription requires a basic account (see Part 2, § 4). It includes all functions of the basic account (see Part 2, § 4(3)). These functions are also free of charge within the Immomio Now subscription.

(4) In certain regions, an Immomio Now subscription is only available in the paid variant (see Part 4 of these Terms in this regard). You can find an overview of the free and paid regions here.

§ 3 Conclusion of the contract for the free Immomio Now subscription

(1) To take out an Immomio Now subscription, please first select the product variant you want in your user account. Immediately before you place your order, you will be shown the main characteristics, the total price per billing period and per month, the term and the termination conditions. If you would like to change your selection, please use the link displayed there.

(2) By clicking the ‘Subscribe for free’ button, you submit a binding offer to conclude the free Immomio Now subscription subject to our Terms linked there. We will confirm receipt of your order by email without undue delay; the contract is concluded with this contract confirmation.

§ 4 Right of withdrawal

If you are a consumer, you have a right of withdrawal when taking out the free Immomio Now subscription in accordance with the cancellation policy in Annex 1.

§ 5 Updates and warranty

(1) During the term of the contract, we will provide you with the updates, including security updates, that are necessary to keep Immomio Now in conformity with the contract, and will inform you about them (Section 327f BGB).

(2) We may change Immomio Now beyond what is necessary to maintain its conformity with the contract if there is a valid reason for doing so, you do not incur any additional costs as a result and we inform you about the change clearly and comprehensibly (Section 327r(1) BGB). Valid reasons are in particular adaptation to new technical developments or security requirements, implementation of statutory or regulatory requirements, adaptation to changed interfaces of the connected providers and the improvement or extension of functions.

(3) If a change impairs your ability to access or use Immomio Now more than insignificantly, we will inform you on a durable medium (e.g. by email) within a reasonable period before the change about the characteristics and timing of the change and about your right to terminate the contract free of charge within 30 days (Section 327r(2) to (5) BGB).

(4) The statutory rights in the event of defects in digital products (Sections 327 et seq. BGB) apply to Immomio Now.

§ 6 Term and end of the subscription, termination or deletion of the basic account

(1) The contract for the free Immomio Now subscription runs for an indefinite period. You may terminate it at any time without notice. Immomio may terminate the contract with ordinary notice of at least one month.

(2) You can declare your termination at any time using the ‘Cancel contract’ button, which you will find in the footer of our website. We will then immediately confirm to you the content, the date and the time of receipt of the termination as well as the date on which the contract ends as specified by you. We will then review your termination and send you a further email regarding the processing of your subscription.

(3) The right of both parties to terminate for good cause remains unaffected.

(4) When the Immomio Now subscription ends, your basic account continues to exist unless you terminate it as well. In particular, you will continue to have access to properties and application processes in relation to any connected providers you may have (see above, Part 2, § 5).

(5) Please note that having a basic account is a prerequisite for an Immomio Now subscription. If you delete your basic account or terminate your contract of use for the basic account, this is also deemed to be termination of your Immomio Now subscription at the next possible date.

Part 4 – Supplementary terms and conditions for the paid subscription to Immomio Now

§ 1 Scope

Part 4 of these Terms only applies if you take out a paid Immomio Now subscription. Please also note the contractual terms in Parts 1 to 3 of these Terms.

§ 2 Subject matter of the services

(1) The paid Immomio Now includes all functions of the basic account (see above, Part 2, § 4) and of the free Immomio Now subscription (see above, Part 3, § 2). In addition, for the duration of its term, it includes the following services from Immomio:

  • Connection to all provider tenants in all regions

see Part 4, § 5 below for further details

  • One-time, cross-provider SMS verification of the account

see Part 4, § 6 for further details

  • Personal support

see Part 4, § 7 for further details

(2) In certain regions, the paid variant of an Immomio Now subscription is not necessary. You can find an overview of the free and paid regions here.

§ 3 Conclusion of the contract for the paid Immomio Now subscription

(1) To take out a paid Immomio Now subscription, please first select the product variant you want in your user account. Immediately before you place your order, you will be shown the main characteristics, the total price per billing period and per month, the term and the termination conditions. If you would like to change your selection, please use the link displayed there. You can find an overview of the free and paid regions here.

(2) By clicking the ‘Subscribe with obligation to pay’ button, you submit a binding offer to conclude the paid Immomio Now subscription subject to our Terms linked there. We will confirm receipt of your order by email without undue delay; the contract is concluded with this contract confirmation.

§ 4 Right of withdrawal

If you are a consumer, you have a right of withdrawal for the paid Immomio Now subscription in accordance with the cancellation policy in Annex 2.

We will only begin providing the services before the withdrawal period expires if you expressly request this when placing your order by actively ticking the corresponding box. If you withdraw, you must pay a reasonable amount for the services provided up to the time of withdrawal. The reasonable amount payable in the event of withdrawal is calculated pro rata on the basis of the agreed price for the current billing period (Section 357a(2) BGB).

§ 5 Connection to all provider tenants

With the paid Immomio Now subscription, we provide your user account as a cross-provider user account to which, for the duration of the subscription term, the tenants of all providers on Immomio in all regions in Germany, including all paid regions, are linked.

§ 6 One-time, cross-provider SMS verification

With the paid Immomio Now subscription, we provide you with the function of verifying your user account once by SMS. This means that you do not have to verify your identity separately for each provider, but only once through a cross-provider verification of your account.

§ 7 Personal support

With the paid Immomio Now subscription, you can use personal support from staff of our helpdesk on working days between 9 am and 5 pm, for example if you have questions about using the functions of your user account. Working days means Monday to Friday, excluding public holidays at Immomio’s registered office. You can use the support by email or via the support form on our website. For this purpose, please have ready the customer number and contract number that we sent you with the contract confirmation.

§ 8 Fee

(1) If you take out the paid Immomio Now subscription, you undertake to pay Immomio a monthly fee. We state the amount of the monthly fee both in the order overview before you submit your contractual declaration (see above under § 3(1)) and in our contract confirmation (§ 3(2) sentence 2).

(2) The fee is payable in advance at the beginning of each billing period.

(3) The fee includes statutory VAT.

(4) Immomio does not charge any further fees, charges or expenses in connection with the Immomio Now subscription. The fee is a flat rate and fully covers all of Immomio’s services under the paid Immomio Now subscription, regardless of the extent to which you use these services in the respective month. In particular, the following are covered by the fee, without any usage-based or additional fees being incurred:

(a) the number of providers to which your account is technically linked;

(b) the storage space for your profile, your documents and your messages;

(c) the number and scope of transmissions and updates of your data to the providers you have selected;

(d) the number and scope of the messages and documents you exchange via the protected communication;

(e) the use of the data protection functions, in particular releases, revocations of releases and deletion requests;

(f) the volume of data transferred and the computing and server capacity used by Immomio;

(g) updates, maintenance and support;

(h) the costs of service providers that Immomio uses to provide the services.

(5) The flat listings you view and the applications you submit are not covered by the fee. Both are already available to you in the free basic account.

(6) Paragraph 4 does not affect statutory claims, in particular for compensation for the value of services provided in the event of withdrawal (§ 4), or Immomio’s claims under separately concluded contracts for additional services (e.g. if you instruct us to obtain a SCHUFA credit report).

(7) You bear the costs of your own internet access and your devices yourself.

§ 9 Payment and default in payment

(1) Immediately after the contract is concluded (see above, § 3(2)), we will redirect you to the website of the payment service provider we use. To make your payment, please select your preferred payment method there and click on the button provided by the payment service provider.

(2) We accept the following payment methods: credit card, PayPal, Apple Pay, Google Pay.

(3) We do not charge a separate fee for using a payment method.

(4) We provide invoices to you electronically by email.

(5) If you fail to meet your payment obligation for reasons for which we are not responsible, we are entitled to withhold our services under the paid Immomio Now subscription by blocking your access to the subscription services until you have made your payment. Section 320(2) BGB remains unaffected. If you do not make your payment within 30 days despite a further request, we are entitled to terminate your Immomio Now subscription for cause (extraordinary termination).

(6) Your basic account remains unaffected by the blocking of access to the subscription services or by our extraordinary termination of the Immomio Now subscription.

§ 10 Term and end of the subscription, termination or deletion of the basic account

(1) The contract for the paid Immomio Now subscription runs for an indefinite period.

(2) You may terminate the contract at any time with effect from the end of the current billing period. The billing period is one month, starting on the day the contract is concluded.

(3) You can declare your termination at any time using the ‘Cancel contract’ button, which you will find in the footer of the website. We will then immediately confirm to you the content, the date and the time of receipt of the termination as well as the date on which the contract ends as specified by you. We will then review your termination and send you a further email regarding the processing of your subscription. If you do not specify a date when terminating, the termination takes effect at the earliest possible date.

(4) Immomio may terminate the contract with ordinary notice of one month with effect from the end of a billing period.

(5) The right of both parties to terminate for good cause remains unaffected.

(6) When the Immomio Now subscription ends, your basic account continues to exist unless you terminate it as well. In particular, you will continue to have access to properties and application processes in relation to any connected providers you may have (see above, Part 2, § 5).

(7) Please note that having a basic account is a prerequisite for an Immomio Now subscription. If you delete your basic account or terminate your contract of use for the basic account, this is also deemed to be termination of your Immomio Now subscription at the next possible date.

§ 11 Price changes

(1) We will offer you any change to the price for future billing periods in text form no later than one month before it takes effect. It only becomes effective if you expressly consent to it.

(2) If you do not consent to the price change by the time it takes effect, the previous price continues to apply. In this case, we may terminate the subscription in accordance with Part 4, § 10(4). We may already declare the termination with the offer of the price change, conditional on your not consenting to the price change by the time it takes effect; we will specifically draw your attention to this in the offer. Your basic account remains unaffected by such a termination.

Part 5 – Terms and conditions for a free Immomio Now subscription with a WBS

However, use of the subscription is limited to properties that are WBS-restricted housing (for the definition, see above, Part 1 of these Terms, § 2).

(2) In certain regions, an Immomio Now subscription is free of charge even without a WBS. You can find an overview of the free and paid regions here.

We will then immediately confirm to you the content, the date and the time of receipt of the termination as well as the date on which the contract ends as specified by you. We will then review your termination and send you a further email regarding the processing of your subscription.
