the Immomio letting solution, letting platform function (section 3),
the Immomio letting solution, digital signature module function (section 4)
the contact form, business communication and mailings (section 5).

  1. Use of the website

When you visit our website, we process personal data in order to enable you to use it (usage data). This includes your IP address and data on the start, end and subject of your use of the website as well as, where applicable, identification data (e.g. your login details if you log in to a secure area). It also includes the technical data transmitted by your browser, such as browser type / browser version, the previously visited website (referrer URL), screen resolution, operating system, where applicable device information (e.g. device type), etc. We process this usage data in order to provide this website and design it in line with requirements, on the basis of our legitimate interest (Art. 6(1)(f) GDPR). You are not obliged to provide personal data. If you do not provide personal data, individual functions of the website may not work or may only work to a limited extent. There are no other consequences.

  1. Use of the Immomio letting solution, letting platform function

In addition to the purely informational use of our website, we offer various services in connection with letting and renting residential property. One of these functions is the Immomio letting platform. As a landlord, you can register as a provider and use the Immomio letting platform to search for prospective tenants (see 3.1 below). As a prospective tenant, you can create a prospective tenant profile and provide personal details, which are then released to landlords in accordance with your instructions (see 3.2 below).

3.1 Registration as a provider

Providers of real estate have the option of registering with us online. Details of our offer for providers can be found on our website under Functions; you can find our ‘General Terms and Conditions for Commercial Providers’ here. To register as a provider, we need a valid e-mail address, your first name and surname and a password of your own choosing. During the further online registration as a provider, we then ask you to provide us with the following data:

E-mail address
First name and surname
Company name
Billing address

Further voluntary information may be provided.

If you use our services as a provider, we store the data necessary for the performance of the contract. We use the personal data you have provided for the duration of your use of our online platform, unless you delete it beforehand or have us delete it.

You can manage and change or update all details yourself in the protected login area. As a provider, you can also give us your consent to contact you in order to send you information relevant to the offer or your registration, such as changes to the scope of the offer or technical circumstances, by e-mail.

If, as a provider, you wish to use additional services and decide via our website to use an electronic payment method (PayPal, Sofortüberweisung, credit cards), you will be redirected to the website of the respective provider. In this case, please inform yourself about data protection with the respective provider of the payment method.

The legal basis for processing your personal data or the personal data of your employees is Art. 6(1)(b) GDPR, insofar as we have concluded the contract for the use of the letting platform with you and you are set up there as a user. Insofar as you are an employee or authorised representative of a provider and use the letting platform in this role, the legal basis is Art. 6(1)(f) GDPR. Our legitimate interest then lies in providing our contractual services to the provider in accordance with the contract.

You are not obliged to provide personal data. If you do not provide personal data, individual functions may not work or may only work to a limited extent. There are no other consequences.

3.2 Registration as a prospective tenant

As a prospective tenant, you have the option of registering on our platform online free of charge. Details of our offer for prospective tenants can be found in our ‘General Terms and Conditions for Tenants’. For the registration as a prospective tenant itself, we need your first name and surname, an e-mail address and a password of your own choosing.

As a prospective tenant, you have the option of voluntarily providing us with the following additional data in order to complete your prospective tenant profile:

– Address
– Form of address
– Information on housing entitlement certificates (Wohnberechtigungsschein, WBS; ‘§5-Schein’)
– Information on household size and household type
– Date of birth
– Information on occupation and household income
– Animals living in the household
– Information on guarantees
– Upload of documents

If you register as a prospective tenant and maintain a prospective tenant profile, we store the data necessary for the provision of our services. Furthermore, we store the personal data you have provided for the duration of your use of the prospective tenant pool, unless you delete it. You can manage, change, update or delete all details yourself in the protected prospective tenant area. You can grant providers whose flats you wish to apply for the temporary right to view your personal data. You can withdraw this right from the individual provider at any time by clicking “Withdraw application”. This means you always remain in control of your personal data.

We pass on your personal data to providers of residential property that matches your search criteria if and insofar as you have consented to this disclosure in advance. You can prevent the disclosure of personal data at any time and manage your search criteria yourself in your prospective tenant area. This means you always remain in control of the disclosure of your personal data.

The legal basis for the processing of your personal data by Immomio is your consent pursuant to Art. 6(1)(a) GDPR.

Applying for a flat is always free of charge. If you wish to use additional services and decide via our website to use an electronic payment method (PayPal, Sofortüberweisung, credit cards) and/or to obtain proof of creditworthiness, you will be redirected to the website of the respective provider. In this case, please inform yourself about data protection with the respective provider of the payment method.

You are not obliged to provide personal data. If you do not provide personal data, individual functions may not work or may only work to a limited extent, and it may not be possible to send you offers of flats. There are no other consequences.

  1. Use of the Immomio letting solution, digital signature module function

The Immomio digital signature module enables the customer to conclude a digital tenancy agreement with its tenants. The digital tenancy agreement is intended to replace a tenancy agreement concluded in writing or in any other form.

To conclude the digital tenancy agreement, the customer enters the individual contract data (tenant, tenancy term, etc.) in its account and uploads its contract template in .docx or .pdf format. The customer’s contract template is then supplemented accordingly and linked to the DocuSign platform This process can also run automatically via the Immomio REST API. The customer has the option of concluding the contract with the tenant using various signature variants, which are described in the General Terms and Conditions for landlords.

The authorised signatories on the provider’s side receive an e-mail notifying them that a tenancy agreement is ready for signature and are directed via a link to the contract document at DocuSign. The contract text is then linked to a simple electronic signature generated at DocuSign. As soon as all parties have signed, a copy of the generated document is sent to the parties and stored in the DocuSign database. This completes the process of concluding the digital tenancy agreement. The legal basis for processing the provider’s personal data is Art. 6(1)(b) GDPR, insofar as we have concluded the contract for the use of the Immomio letting solution with you and you are set up there as a user. Insofar as you are an employee or authorised representative of a provider and use the Immomio letting solution in this role, and insofar as personal data of tenants is processed, the legal basis is Art. 6(1)(f) GDPR. Our legitimate interest then lies in providing our contractual services to the provider in accordance with the contract.

You are not obliged to provide personal data. If you do not provide personal data, the digital tenancy agreement functions may not be provided or may only be provided to a limited extent. There are no other consequences.

  1. Contact form, business communication and mailings

You can contact us, among other ways, via the form provided on our website or by e-mail. For this purpose, we ask you to provide your e-mail address and your name so that we can deal with your enquiry. This data is used only to deal with your enquiry. In addition, we communicate with registered Immomio users about changes and news relating to Immomio. The legal basis for this is your implied consent (Art. 6(1)(a) GDPR); where we have a contractual relationship and contact you for this reason, it is Art. 6(1)(b) GDPR. Otherwise, the legal basis may also be Art. 6(1)(f) GDPR; in this case, our legitimate interest lies in communicating with you about Immomio

If you wish to receive our newsletter and register for it, we collect your e-mail address and send you a confirmation e-mail with a confirmation link that you must click to subscribe to our newsletter. You can unsubscribe from the newsletter and object to e-mail advertising at any time. You will find an option to declare your objection in every newsletter and every other advertising e-mail we send you. We also send you our newsletter advertising our own similar services if you register with Immomio and have not objected. The legal basis under data protection law for this is your consent (Art. 6(1)(a) GDPR).

You are not obliged to provide personal data. If you do not provide personal data, we may not be able to send you mails and/or may not be able to answer enquiries, or only to a limited extent. There are no other consequences.

  1. Google Analytics

This website uses Google Analytics, a web analysis service of Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (‘Google’). Google Analytics uses cookies (see section 6) to enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored or processed there. The level of data protection in the USA does not correspond to the European data protection standard. Google does not provide appropriate safeguards pursuant to Art. 46 GDPR for the transfer of data to the USA. Nor are effective legal remedies available. It is conceivable, for example, that US authorities may access your personal data. However, your IP address is first truncated by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area and thus anonymised. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide further services to the website operator relating to website use and internet use. The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data. Before we process your data for the purposes stated in this section, we obtain your consent to the use of Google Analytics and to the transfer of data to the USA. You can give this consent to the use of Google Analytics and to the transfer of data to the USA in the cookie banner as described in section 6 (cookies in categories 2 to 4) and withdraw it as described in section 6.
You can find the provider’s privacy information here: https://www.google.de/intl/de/policies/

You can download the browser plug-in here to prevent the activity of the service: https://tools.google.com/dlpage/gaoptout?hl=de.

  1. Google reCAPTCHA

We use Google reCAPTCHA to protect our websites and IT systems against spam and abusive automated entries (so-called ‘bots’) in our contact form. Google reCAPTCHA is a service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (‘Google’). This service can access the browser on your device by means of a script and cookies and collect usage data, on the basis of which Google analyses whether the user is a real human or a bot. In the process, various pseudonymous data relating to you may be processed, in particular your IP address, browser type and version, your browser settings (e.g. language), installed browser plug-ins, technical information about your device, information about the operating system you use, your referrer URL (i.e. the website from which you reached our contact form), your user behaviour (mouse movements and clicks in the contact form, time spent on the website, input and scrolling behaviour, as well as your Google account information. Google has no access to the content of your message to us in the contact form. You can view Google’s privacy policy here.

The data collected by means of Google reCAPTCHA may also be stored on Google servers in third countries outside the European Economic Area, in particular in the USA. In its adequacy decision of 10 July 2023, the EU Commission determined that the level of data protection in the USA is comparable to that in the EU, provided that the data importer is certified under the EU-US Data Privacy Framework. Google is certified under the EU-US Data Privacy Framework.

The use of Google reCAPTCHA and the associated data processing and data transfer are based on your consent pursuant to Art. 6(1)(a) GDPR and, where applicable, Section 25(1) TDDDG (German Telecommunications Digital Services Data Protection Act). We obtain this consent in our contact form before Google reCAPTCHA is activated. You can withdraw your consent at any time with effect for the future by sending an e-mail to the following e-mail address: service@immomio.de

  1. Social networks and embedded YouTube videos

Our website contains links to social networks (e.g. Facebook or Instagram) as well as embedded videos from the streaming service YouTube. These services are operated exclusively by third parties. If you follow the links or play videos, information may be transmitted to these third parties. This means that, as a rule, no personal data is passed on when you visit our site. Data is only transmitted to the respective provider if you click on one of the social share buttons. For the purpose and scope of the data collection and the further processing and use of the data by the service provider, as well as your rights in this regard and settings options for protecting your privacy, please refer to the privacy information of the respective service provider. 1. Transfer to third parties

We only pass on personal data insofar as this is necessary for the provision of our service or is required by law in this context (see Art. 6(1)(a) and (c) GDPR). Within the scope of the purposes stated here, personal data is forwarded to service providers who work for us and, in particular, support us in providing our services. In addition to their statutory obligation to comply with all data protection provisions, these service providers are bound by us to further contractual data protection requirements. As a rule, this includes an obligation as a processor pursuant to Art. 28(3) GDPR.

Otherwise, we only transfer personal data to third parties if there is a legal permission to do so or if you have given your prior consent. You can withdraw any consent you have given at any time with effect for the future. We only pass on your data to public authorities within the scope of our statutory obligations or on the basis of an official order or court decision, and only insofar as this is permissible under data protection law.

  1. Transfer to countries outside the EU

Insofar as necessary for our purposes, we may also transfer your data to recipients outside the EU. We only do so within the scope of the data protection requirements for transfers to third countries, if it is ensured that the recipient of the data guarantees an adequate level of data protection within the meaning of Chapter V GDPR and no other legitimate interests worthy of protection preclude the data transfer. To ensure an adequate level of protection at the recipient of the data, we use in particular the standard contractual clauses of the EU Commission for the transfer of personal data to third countries.

  1. Deletion

We delete your personal data as soon as it is no longer required for the purposes pursued by the processing and insofar as no statutory retention obligations preclude this. In addition, registered prospective tenants can delete their profile at any time in their account area. The personal data is then no longer visible to landlords with immediate effect and is subsequently deleted in accordance with the data protection requirements.

  1. Your rights

As a data subject, you have the right to obtain confirmation as to whether data relating to you is being processed by Immomio and, if so, the right of access to this personal data (Art. 15 GDPR), the right to rectification of your inaccurate data (Art. 16 GDPR), the right to erasure (Art. 17 GDPR) and the right to restriction (blocking) of your data (Art. 18 GDPR).

In addition, in the case of processing based on Art. 6(1)(e) or (f) GDPR, you can object to the processing (Art. 21 GDPR), in which case, except in the case of direct marketing, you must set out a particular reason. Insofar as you have given consent under data protection law, you can withdraw it at any time with effect for the future.

Insofar as you have provided this data, you can request the transfer of the data (Art. 20 GDPR). Whether and to what extent these rights exist in the individual case and under what conditions they apply is laid down by law in the provisions cited. If the processing is based on consent within the meaning of Art. 6(1)(a) or Art. 9(2)(a) GDPR, you can withdraw it at any time for the future (Art. 7(3) GDPR). You also have the right to lodge a complaint with the competent data protection supervisory authority (Art. 77 GDPR). If you have questions or complaints about data protection at Immomio, we recommend that you first contact our data protection officer.

  1. No automated individual decision-making

We do not use your personal data for automated individual decision-making within the meaning of Art. 22(1) GDPR.

  1. Changes to the privacy policy

New legal requirements, business decisions or technical developments may require changes to our privacy policy. The privacy policy will then be amended accordingly. You will always find the latest version on our website.

We may share the personal data you provide in connection with our event with other companies in our group of companies, in particular with Deutsche Immobilien IT & Marketing GmbH, Zippelhaus 2, 20457 Hamburg (‘DIT’). This is done in pursuit of the legitimate interests of Immomio and DIT in maintaining joint business contacts with interested companies in the housing industry. You can object to this transfer of your data to DIT at any time with effect for the future under the conditions of Art. 21(1) sentence 1 GDPR.

Typical retention periods under German commercial and tax law are six years from the end of the year for business letters (including e-mails) and ten years from the end of the year for accounting-relevant data.
